Terms of service

Effective and last updated: August 27, 2026

These Terms govern access to TruckER's website, founding networks, accounts, product previews, and delivery-matching tools. By creating or using an account, you agree to these Terms and the Privacy Policy. Motor carriers also agree to the Motor Carrier Platform Participation Agreement.

TruckER is in pre-launch. Carrier matching and Instant Book are off. Joining, creating an account, submitting verification, or viewing an example does not guarantee work, revenue, verification, payment, regional activation, or a launch date.

1. Eligibility and accounts

You must be at least 18, legally able to contract, and authorized to act for any organization you register. Information must be accurate and current. Each person must use their own login, protect credentials, use only assigned permissions, and promptly report unauthorized access. TruckER may require identity, authority, qualification, insurance, or other verification and may deny, restrict, or suspend access.

2. What TruckER is

TruckER provides technology for founding-network recruitment, profiles, verification workflows, qualification-based matching, requests, selection, assignment records, delivery status, and proof of delivery. TruckER is not a motor carrier, broker, freight forwarder, employer, staffing agency, insurer, payroll provider, escrow provider, or guarantor. How the Platform operates—not labels alone—determines any legal classification.

Users independently decide whether to post, request, accept, select, assign, or perform an opportunity. Transportation services and payment are direct arrangements between the participating business, driver, or motor carrier. TruckER does not control transportation methods or take possession of cargo.

3. Account types and responsibility

Drivers are responsible for accurate CDL, endorsement, identity, experience, availability, classification, and vehicle information and for maintaining every qualification required for work they perform. Businesses are responsible for accurate delivery, cargo, route, vehicle, pay, timing, and safety information and for their selection and payment decisions.

Motor carriers are responsible for their authority, insurance, drivers, employment and classification, vehicles, safety, cargo, dispatch, taxes, and transportation services. Carrier team members and roster drivers use separate role-based logins. Motor-carrier use is also governed by the Motor Carrier Platform Participation Agreement.

A motor carrier has one company account per USDOT number. The company may invite authorized owners, managers, dispatchers, billing users, viewers, and company drivers, and every person must use their own secure login; shared credentials are prohibited. To the fullest extent permitted by law, the carrier is the transportation-service provider and remains solely responsible for its drivers and personnel, dispatch, authority, insurance, equipment, vehicles, safety, regulatory compliance, cargo, load acceptance, transportation performance, claims, taxes, compensation, and payment collection.

A motor carrier receives its own Carrier Reliability Score, which is separate from every individual driver's reliability score and is never presented as a driver's score or calculated by copying or averaging driver scores. During pre-launch the carrier score displays “Not yet rated” until the carrier has completed qualifying deliveries. Carriers follow the normal load-board workflow: review the posted opportunity and terms, request or accept through the company account when enabled, independently evaluate the load, assign an eligible company driver and vehicle, perform the transportation services, update delivery status, and provide proof of delivery. TruckER supplies matching and tracking technology and does not become the carrier, employer, dispatcher, broker, insurer, or party providing transportation.

4. Verification and matching

TruckER may compare information with government or third-party sources and request updates. A verification badge reflects only a defined review at a point in time; it is not a government endorsement, safety certification, insurance opinion, warranty, or promise. Users must independently confirm that a person, company, vehicle, route, cargo, and arrangement meet their requirements and applicable law.

Eligibility is checked using available Platform data and may change. A listing or match is not a guarantee that information remains accurate or that performance, payment, safety, or compliance will occur.

5. Pre-launch controls and Instant Book

TruckER may stage, test, limit, pause, or deactivate features by user, account, or region. Carrier matching stays disabled until TruckER deliberately activates an approved pilot. Instant Book is not available to motor carriers. Driver Instant Book, if later activated, remains subject to explicit eligibility and server-side controls; no current screen or preview promises access.

6. Pricing and payments

Drivers and motor carriers pay $0 in TruckER platform fees and TruckER takes 0% of their agreed transportation pay under the current founding model. Each founding business's first successfully completed match has no TruckER platform fee; after that, the business owes TruckER $75 only after completed delivery and accepted proof of delivery, unless a later offer accepted by that business states otherwise.

Transportation pay is stated or agreed up front and settled directly between the business and the driver or motor carrier. TruckER does not hold, escrow, transmit, guarantee, or collect transportation pay. Users are responsible for payment terms, invoices, collection risk, expenses, taxes, refunds, claims, and lawful reporting.

7. Acceptable use

You may not falsify information; impersonate others; share logins; evade suspension; misuse personal or confidential data; manipulate reviews; interfere with security; scrape, reverse engineer, or overload the Platform; upload malware; discriminate or harass unlawfully; facilitate unsafe or illegal transportation; double-broker or re-broker without authority and disclosure; or claim TruckER guarantees, employs, dispatches, insures, or certifies you.

8. Content, privacy, and records

You retain ownership of lawful content you submit and grant TruckER the rights needed to host, process, display, transmit, secure, and operate that content. You must have the rights and lawful basis to provide it. Use another user's information only for authorized Platform and delivery purposes. TruckER handles information under the Privacy Policy and may preserve records needed for safety, fraud, disputes, legal obligations, or enforcement.

9. Suspension and termination

You may stop future use. TruckER may restrict or suspend access for suspected safety, fraud, security, authority, insurance, verification, identity, legal, payment, conduct, or Platform risk. Ending access does not cancel accepted transportation duties, payment obligations, claims, or terms that by nature survive.

10. Disclaimers and limits

The Platform is provided “as is” and “as available,” to the maximum extent permitted by law. TruckER disclaims warranties of uninterrupted operation, accuracy, fitness, demand, work, revenue, payment, qualifications, safety, legal compliance, or a particular match. TruckER is not responsible for another user's conduct, cargo, vehicle, transportation, payment, injury, loss, or agreement.

To the maximum extent permitted by law, TruckER will not be liable for indirect, special, incidental, consequential, exemplary, or punitive damages or lost profits, opportunities, goodwill, or data. TruckER's aggregate liability will not exceed the greater of $100 or Platform fees you paid TruckER in the six months before the event. Limits do not apply where law prohibits them.

11. Indemnity

To the extent permitted by law, you will defend and indemnify TruckER and its personnel against third-party claims and reasonable costs arising from your content, account, business, transportation, cargo, personnel, vehicle, payment, privacy or security incident, legal violation, or breach, except to the extent finally caused by the indemnified party's gross negligence or willful misconduct.

12. Governing law and changes

Washington law governs, except where federal law controls. Before a claim, the parties will give notice and attempt good-faith resolution for 30 days. Unless law requires otherwise, disputes may be brought in state or federal courts in King County, Washington. TruckER may update these Terms prospectively with notice and will seek renewed acceptance when appropriate.

Before public marketplace launch, TruckER must add its final legal entity, notice address, support contact, and any counsel-approved dispute revisions. If one term is invalid, the rest remains effective. These Terms, the Privacy Policy, and applicable account-specific agreements are the complete Platform agreement.
